"Top 5" Title 42 (f) List of Positions
The list of T-42 209(f) positions (“Top 5”) exempt from the HHS Performance Management Program (PMAP) coverage is now revised to include the extramural professional designation of “Scientific Executive” as determined by the Extramural Title 42(f) Committee (ETFC). The revised list of Title 42 (f) positions exempt from PMAP follows:
- IC Directors
- IC Deputy Directors
- IC Scientific Directors
- Scientific Executives - The Scientific Executive Designations Model Category Criteria (.doc)
- Clinical Directors
- Associate Directors in the NIH Office of the Director (OD) who report directly to the Director, NIH (Some scientists in this category will be designated by the ETFC as Scientific Executives.)
- Office Heads in the NIH OD who report directly to the Director, NIH (Some scientists in this category will be designated by the ETFC as Scientific Executives.)
NOTE: Title 42 (f) Senior Scientific Officer and Scientific Policy/Program Leader Tiers 1& 2 scientists continue to be covered by PMAP.
PLACEMENT INTO SCIENTIFIC EXECUTIVE POSITIONS AND IMPACT ON 2008 PERFORMANCE APPRAISALS
Title 42 “Top 5” employees are on a fiscal year appraisal period and use the same performance plan template as HHS Senior Executive Service members. The Executive/SES performance template may be found at: http://hc.od.nih.gov/PerfMgmt/SES/SESPerfPlantemplate.doc
Employees currently under PMAP going into Scientific Executive positions are affected as follows:
- The PMAP mid-year progress review should be documented, but there is no need to rate the employee unless the employee is going into a new position (i.e., the employee is not converting into the same duties as currently being performed).
- Employees are to be placed on performance plans using the DHHS Executive/Senior Executive Service (SES) Performance Plan template ideally not later than July 1, 2008 in order to meet the minimum 90-day rating period. Employees must be placed on the Executive/SES performance plan within 30 days from appointment as a Scientific Executive. If the minimum 90-day period has not been met as of September 30, 2008; the appraisal period may be extended until the minimum time requirements are met, at which time the annual appraisal may be completed.
Employees already on Executive/SES performance plans going into Scientific Executive positions are affected as follows:
- Employees remain on their current plans provided they are performing the same duties. If the duties are changing, then a new performance plan must be established ideally not later than July 1, 2008. Employees must be placed on the new Executive/SES performance plan within 30 days from appointment as a Scientific Executive. If the minimum 90-day period has not been met as of September 30, 2008; the appraisal period may be extended until the minimum time requirements are met, at which time the annual appraisal may be completed.
FY 2008 PERFORMANCE AWARDS
The FY 2008 performance awards for IC Directors, IC Deputy Directors, Scientific Directors, and Scientific Executives will be considered by the NIH Deputy Directors and final decisions made by the NIH Director. Performance awards are expected to be paid in January 2009. The Office of Human Resources will transmit specific FY 08 close-out guidance for SES and Title 42 “Top 5” in the fall 2008.
